Brand New LS-QL/R5 - In emergency mode

I got a brand new LS-QL/R5, right out of the box , pop a hard drive in, and Navigator2 already it says its in emergency mode. (its my second device)

I downloaded the LSQL-LL0B fireware updater but when I run it, it says LS-QL/R5 that needs updating wasn't found.  Does that mean it is already updated or that it didn't find it?
