We have integrated the nas with ad no problem.  User names and groups come over with no problem.

We have set up a share for data storage with subfolders just like we would on a 2003 server.  Our question is how do we set permission on the subfolders to restrict access to certain users?

It appears as if you can not.  Surely this can not be the case.  What would be the purpose of integrating with ad then?

As has been covered previously in other threads, sub-folder permissions cannot be set on the NAS.  The point of AD integration would be to populate users and groups without having to manually add them in.  The AD integration helps eliminate that tedium.

So when will this bug be fixed?

It's not a bug, this device isn't a server.  I'm afraid it's a backup that has the ability to restrict folders on the root level to prevent unauthorized access to sensitive data.  My apologies for any confusion this has caused.
